3. Pricing & Payments

All prices are listed in AUD (Australian Dollars) unless stated otherwise.

Payment terms will be outlined in your invoice or proposal.

Work will begin only after the initial payment or deposit has been received (when applicable).

For ongoing service packages (monthly retainers), payment is required in advance.
We reserve the right to suspend or stop services if payment is overdue.
4. No Guarantees of Results
While we strive to deliver the best possible outcomes, marketing performance varies due to multiple factors, including:

Platform behaviour (Google, Meta, etc.)
We do not guarantee specific results (e.g., number of leads, profits, conversions).
5. Refunds & Australian Consumer Law (ACL)
Under the Australian Consumer Law, you are entitled to consumer guarantees that cannot be excluded.
You are entitled to a replacement or refund for a major failure, and compensation for reasonably foreseeable loss or damage.
However, we do not offer refunds if:

You decide not to continue with a campaign

External factors affect campaign results (competitors, market changes, platform behavior)
Service-based fees are non-refundable once work has commenced.
6. Intellectual Property

All content, strategies, designs, creative assets, and marketing materials created by us remain our intellectual property until full payment has been made.

You may not reuse, resell, or distribute our work without written permission.
All website content, graphics, trademarks, and branding remain owned by AMSolutions Media.
7. Client Responsibilities
You agree to:

Provide accurate information and materials needed to complete your project.

Supply timely feedback, approvals, or content required for your service.

Ensure you have the rights to any content, images, or data you supply to us.
We are not responsible for delays caused by lack of communication or missing content.
8. Liability Limitation

We are not responsible for:

Account suspensions due to platform policy violations

Loss of data caused by third-party services
11. Termination of Services
We may terminate a project or service if:

Payments are overdue

Communication stops for more than 14 days

There is misuse of our intellectual property or abusive behaviour
Outstanding invoices remain payable.
12. Governing Law (Australia)
These Terms are governed by the laws of Australia.
Any disputes will be handled by the courts in the state or territory where AMSolutions Media operates.
